Background: The decision whether to initiate cardiopulmonary resuscitation may sometimes be ethically complex. While studies have addressed some of these issues, along with the role of nurses in cardiopulmonary resuscitation, most have not considered the importance of nurses acting as advocates for their patients with respect to cardiopulmonary resuscitation. Research objective: To explore what the nurse’s advocacy role is in cardiopulmonary resuscitation from the perspective of patients, relatives, and health professionals in the Basque Country (Spain). Research design: An exploratory critical (...) qualitative study was conducted from October 2015 to March 2016. Thematic analysis was used to analyse the data. Participants: Four discussion groups were held: one with patients and relatives (n = 8), two with nurses (n = 7 and n = 6, respectively), and one with physicians (n = 5). Ethical considerations: Approval was obtained from the Basque Country Clinical Research Ethics Committee. Findings: Three significant themes were identified: (a) accompanying patients during end of life in a context of medical dominance, (b) maintaining the pact of silence, and (c) yielding to legal uncertainty and concerns. Discussion: The values and beliefs of the actors involved, as well as pre-established social and institutional rules reduced nurses’ advocacy to that of intermediaries between the physician and the family within the hospital environment. On the contrary, in primary health care, nurses participated more actively within the interdisciplinary team. Conclusion: This study provides key information for the improvement and empowerment for ethical nursing practice in a cardiac arrest, and provides the perspective of patients and relatives, nurses and physicians. The gender-based wage gap in Swedish banks began to increase in 1983 after many years of decline. The growth in the gap between the wages of nonmanagerial women and men employees was particularly high. This article asks, How did this happen? Wage setting, part of the processes of control in capitalist economies, is accomplished through concrete practices under specific historical conditions. The author studied these practices and conditions to understand the increasing wage gap. Through interviews and examination of union and (...) management documents, the author constructs an account of a wage-setting process that, in spite of a strong union and centralized bargaining, allows management to make discretionary wage decisions that favor raises for men over raises for women. Since 1983, competition and deregulation in the banking sector as well as union strategies have created conditions in which an increasing proportion of annual wage increases have been distributed on a discretionary basis. This has led to an increase in the wage gap. The author concludes that policies to raise women's relative wages should pursue general, across-the-board bargaining rather than individualized wage setting. (shrink)

Are intelligent machines really intelligent? Is the underlying philosoph- ical concept of intelligence satisfactory for describing how the present systems work? Is understanding a necessary and sufficient condition for intelligence? If a machine could understand, should we attribute subjectivity to it? This paper addresses the problem of deciding whether the so-called ”intelligent machines” are capable of understanding, instead of merely processing signs. It deals with the relationship between syntax and semantics. The main thesis concerns the inevitability of semantics for any (...) discussion about the possibility of building conscious machines, condensed into the following two tenets: ”If a machine is capable of understanding (in the strong sense), then it must be capable of combining rules and intuitions”; “If semantics cannot be reduced to syntax, then a machine cannot understand.” Our conclusion states that it is not necessary to attribute understanding to a machine in order to explain its exhibited “intelligent” behavior; a merely syntactic and mechanistic approach to intelligence as a task-solving tool suffices to justify the range of operations that it can display in the current state of technological development. A g ainst this opinion, there are authors that think that l e gal control of discretionary decisions is possi b le because th e y defend the e xistence of on l y one co r rect an sw e r . Other authors reject the e xistence of on l y one co r rect an sw er or the possibility of f inding it. N e v er theless, e v en accepting that there are some aspects of discretiona r y decisions that do not der i ve from l e gal no r ms bu t from personal preferences, those preferences must be coherent with some theo r y that contains no r mat i v e l y co r rect criteria. The sharing of research data is now mandated by some funders to encourage openness and integrity in science, to ensure efficient use of research funds, and to provide training resources. Although data sharing has a long history in some parts of science, the full range of possibilities and challenges it offers are only now becoming apparent in the social sciences. This article (a) examines what may be entailed in sharing documented data, (b) provides a historical perspective on data sharing, (c) (...) describes some of the creative and successful data-sharing relationships that have occurred in the social sciences, and (d) discusses some of the main concerns of social scientists with respect to sharing their data and how these concerns might be resolved. Una pregunta inicial y fundamental para empezar la reflexión sería: en qué somos los seres humanos iguales y qué diferencias serían aceptables entre nosotros. Así uno de los retos de la sociedad actual sería cómo conjugar la igualdad social (y económica) y el derecho al reconocimiento cultural diferenciado. A menudo se han presentado como un binomio opuesto y difícilmente reconciliable. De manera tal que para lograr más igualdad de derechos políticos y sociales se tenía que perderla identidad más tribal.

Positive reappraisal strategies have been found to reduce negative affect following the recall of negative personal events. This study examined the restorative effect of two mood-repair instructions (self-compassion vs benefit-focused reappraisal) and a control condition with no instructions following a negative Mood Induction Procedure by using the guided recall of a negative autobiographical event. A total of 112 university students participated in the online study (81% women, Mage: 21.0 years). Immediately following the negative memory recall, participants were randomised to each (...) condition [(self-compassion: n = 36, benefit-focused: n = 39) or a control condition (n = 37)]. Repeated measures ANOVAs 3 (Repair condition) × 3 (Time of mood assessment: pre-recall, post-recall, post-regulation) showed that, as expected, negative mood (sadness, shame, and guilt) worsened significantly after the guided recall in all groups (p <.001). After the mood-repair intervention, participants in the self-compassion and benefit-focused conditions showed a significant reduction in negative mood (p <.019), while such improvement was not observed in the control group. Self-compassion and benefit-focused reappraisal functioned similarly as mood repair strategies after experiencing negative affect induced by the recall of negative personal memories. Implications in the context of autobiographical memory biases are discussed. (shrink)

There is little fear that the concept of motivational bias as proposed by Mele is likely to dampen the current academic ferment (see Mele's Introduction) with respect to self-deception for several reasons: (a) like philosophy, science has more recently abandoned the heuristic of a rational human mind; (b) the concept is parsimonious, applicable to many research topics other than self-deception, and, therefore, scientifically serviceable; (c) as a proximal mechanism it addresses process rather than function, that is, how rather than why (...) questions; (d) it is not as interesting a question as why there is a high prevalence of “real” self-deception (i.e., “garden-variety self-deception” as described by Mele, see sect. 6); and (e) a more penetrating issue is whether “real” self-deception is adaptive. Over the last few decades climate change has been gaining importance in international scientific and political debates. However, the social sciences, especially in Latin America, have only lately become interested in the subject and their approach is still vague. Scientific understanding of global environmental change and the process of designing public policies to face them are characterized by their complexity as well as by epistemic and normative uncertainties. This makes it necessary to problematize the way in which research efforts understand (...) ‘the social’ of climate change. How do ‘the climate’ and ‘the social’ interpenetrate as scientific objects? What does the resulting field look like? Is the combination capable of promoting reflexivity and collaboration on the issue, or does it merely become dispersed with diffuse boundaries? Our paper seeks to answer these and other related questions using Chile as a case study and examining peer-reviewed scientific research on the topic. By combining in-depth qualitative content analysis of each paper with a statistical meta-analysis, we were able to: characterize the key content and forms of such literature; identify divisions and patterns within it; and, discuss some factors and trends that may help explain these. We conclude that the literature displays two competing trends: while it is inclined to become fragmented beyond the scope of the ‘mitigation’ black box, it also tends to cluster along the lines of methodological distinctions traditionally contested within the social sciences. This, in turn, highlights the persistence of disciplinary divisions within an allegedly interdisciplinary field. (shrink)

Peirce predicted that the latter half of the twentieth century would see the failure of the economic order. Was Peirce right? The first part of the article is devoted to Peirce's comments on nineteenth century economic thought. The second part presents some of the concepts that nowadays are more in fashion in the business world. The conclusion is reached that management at present is nearer to Peirce's ideas than to the ideas he was opposing.

In this paper I deal with Armstrong's last theory of states of affairs and its relation to truthmakers for sentences and the problem of uní versáis. More specifically, I discuss his truthmaker principie, rejecting some of the objections that has been raised against it. However, I also try to show that Armstrong's answer to the problem of the negative existencial sentences in terms of totality states of affairs is mistaken. Finally, I rebut Oliver's slinghot argument against truthmakers and also discuss (...) Armstrong theory of states of affairs as truthmakers. /// Este artículo trata de la última teoría de los estados de cosas de Armstrong, así como de su relación con los hacedores de verdad de los enunciados y con el problema de los universales. En particular, se discute su principio del hacedor de verdad, y se rechazan algunas de las objeciones que se han presentado al mismo. Few areas of health law practice present as many quandaries for the ethical health lawyer as health care fraud and abuse. The activities addressed by the anti-fraud laws – such as payment for referrals and submission of false claims – not only have a direct impact on the financial viability of the federal health care programs, but go to the heart of the ethical behaviors expected of those who transact business with the government. The severe consequences of violating these proscriptions (...) include significant monetary penalties, ineligibility to participate in the federal health care programs, and even imprisonment. It is no wonder, then, that compliance with the fraud and abuse laws is a key consideration in any health care venture. At the same time, ethical considerations make this area of health law particularly vexing for counsel, raising numerous challenges that include how to balance the strategic goals of current clients against the interests of future clients and whether to advise clients to self-report potential violations even when illegal intent may not easily be shown. ABSTRACT The jurisdiction of schools has long been contested. Initially, under the sway of loco parentis, parents delegated all authority to educators. With ascendency of the common school movement in the 19th century, however, the doctrine confronted reverses. As the student body increased in size and heterogeneity, families no longer spoke with a single voice. The courts granted parental requests for a more determinative role in their children’s education, prohibited schools from giving religious instruction, and guaranteed students some civil rights. This curtailment of school authority has been countered in recent years by the emphasis on educating the “whole child” with schools taking on responsibilities, such as character development and mental health, arguably a home preserve. While acknowledging the large overlap between school and home, I argue they have differing agendas and capacities. Schools stress the collective, cultivating “we-ness” and agreed upon norms, whereas homes cultivate privacy, individualism, and particularistic values; schools stress equality while homes stress equity; schools are constrained in their use of discipline whereas homes take more liberties. In urging schools to circumscribe and differentiate their role, I nonetheless recognize the problems of doing so. (shrink)

La polémica entre feminismo y transactivismo lleva tiempo ocupando titulares, artículos, debates, etc. En este trabajo se intentan clarificar algunos de los problemas conceptuales que subyacen al conflicto. Para empezar, se abordan los conceptos de «sexo», «género» e «identidad de género» a partir del aparato conceptual proveniente de la ontología social presentada por John Searle. A continuación, ante la conveniencia de disponer de términos para hacer referencia unívoca a las personas de un sexo y de otro, se contrastan diferentes sentidos (...) de «mujer». La discusión de estas nociones permitirá abordar la cuestión política de fondo de si las categorías de género son un instrumento de opresión que abolir o, por el contrario, una identidad que reivindicar; así como una cuestión de cariz más jurídico como para qué deben servir las categorías «hombre» y «mujer» consignadas en leyes y documentos oficiales. Resumen: La capacidad unificadora de una teoría científica es un rasgo usualmente contemplado a la hora de evaluar su adecuación. Kitcher ha elucidado satisfactoriamente tal noción mediante su enfoque de los patrones explicativos. Sin embargo, su perspectiva adolece de ciertas carencias. Concretamente, sostendremos que el requisito de rigurosidad de los patrones para evaluar la capacidad unificadora debe ser repensado, pues atenta contra la heterogeneidad característica de las diferentes aplicaciones de teorías unificadoras. A su vez, mostraremos cómo estas dificultades bien pueden (...) ser subsanadas desde el marco del estructuralismo metateórico sin por ello resignar ninguna de las acertadas intuiciones de Kitcher. -/- Palabras clave: Explicación, Kitcher, estructuralismo metateórico, unificación, unificación espuria. -/- Abstract: Kitcher has satisfactorily explicated unification using his particular approach to scientific explanation. However, we believe that his perspective has certain problems, which have been inherited by more recent approaches to the topic. Specifically, the requirement of stringency of patterns that Kitcher proposes to determine the unifying power of an explanatory pattern undermines the typical and peculiar heterogeneity we can find in different applications of unifying theories.
